Tell a bailiff you are in breathing space (sole name)

Use this letter to tell a bailiff that you are in a breathing space moratorium.

You can choose to send a letter in your own name or in joint names. You may have a debt in joint names, or want to write to your creditors together because you have worked out a joint budget.

  • Fill in your contact details, account number and any extra information you want to include in the grey shaded areas.
  • Today’s date will be added automatically.
  • Sign each letter and enclose a copy of your budget if needed.

Letter in joint names

I ask you not to make a visit or contact me because I have entered a breathing space moratorium through National Debtline). You are required to follow the Debt Respite Scheme (Breathing Space Moratorium and Mental Health Crisis Moratorium) (England and Wales) Regulations 2020.
Reg. 11 (1) says that “During a moratorium period neither a creditor nor the creditor’s agent must contact a debtor in relation to the enforcement of a moratorium debt”.
Reg. 12 (4) says that “During a moratorium period, an enforcement agent appointed in relation to a moratorium debt who is notified of a moratorium or is otherwise aware that a moratorium is in place in relation to a debtor must not in relation to any moratorium debt—
(a)give notice to the debtor under paragraph 7 of Schedule 12 to the Tribunals, Courts and Enforcement Act 2007,
(b)visit the debtor’s place of residence or business for the purpose of taking control of goods,
(c)take control of goods,
(d)sell goods belonging to the debtor unless the enforcement agent took p
