Personal guarantee request

I have been in touch with Business Debtline and I am interested in applying for breathing space to give me more time to get advice and set up a debt solution.

As I have given a personal guarantee for a debt that I have not received a county court or high court judgment for, Business Debtline have asked me to get a solicitor’s opinion about the type of guarantee I have given and its current status as a debt.

This information is needed because not all personal guarantees are eligible to be included as a debt in breathing space and receive the protections given under The Debt Respite Scheme (Breathing Space Moratorium and Mental Health Crisis Moratorium) (England and Wales) Regulations 2020. Eligibility depends on several factors, including the specific terms of the personal guarantee and whether any action is required by a creditor to liquidate the debt. a. A ‘see to it’ obligation: i.e. an undertaking by the guarantor that the principal debtor will perform his own contract with the creditor.
b. A conditional payment obligation: i.e. a promise by the guarantor to pay the instalments of principal and interest which fall due if the principal debtor fails to make those payments.
c. An indemnity.
d. A concurrent liability with the debtor for what is due under the contract of loan.
Whether the personal guarantee creates a ‘liquidated debt that is currently due and owing’. When assessing this matter, please consider the specific terms of the personal guarantee and whether any actions may still be required by the creditor for this debt to be considered a liquidated debt that is now due and owing.
